Terms and Conditions:

“Adryan Does Art” Terms and Conditions apply to all Services PRODUCED BY ADRYAN DOES ART, and LISTED ON www.adryandoesart.com (listed under the “Services”  tab). Upon payment, the Client (“Client” refers to the customer/client/individual who has PAID FOR A SERVICE PROVIDED BY ADRYAN OF “Adryan Does Art”, and will be referred to as “Client” throughout the Terms and Conditions stated below) and the Designer (“Designer” refers to Adryan Fonseca of “Adryan Does Art”, and will be referred to as “Designer” throughout the Terms and Conditions stated below) are in mutual agreement on all Terms and Conditions, and agree as follows:

Work:

The Designer agrees to produce project materials, or the Work (the “Work” REFERS TO THE SERVICE RENDERED BY THE DESIGNER FOR THE CLIENT, and will be referred to as “Work” throughout the remainder of the Terms and Conditions) at the request of the client for fees agreed upon in advance and delivery of the work by an agreed-upon deadline. Designer agrees that he will be the sole author of the Work, which will be original work and free of plagiarism. Designer will cooperate with Client in editing and reviewing the Work prior to completion, submission, and launch. Client also agrees to assist Designer with providing  any required files, info, etc. needed to finish the Work, and is willing to cooperate in a timely fashion to complete the said Work.

Confidentiality:

Designer acknowledges that he may receive or have access to information which relates to the Client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. The Designer agrees to protect the confidentiality of the Client’s proprietary information and all physical forms thereof, whether disclosed to the designer before this agreement is signed or afterward. Upon signature or payment from Client to Designer, the Client agrees Designer can display all materials and final work created for Client on the Designer’s website (adryandoesart.com) or on any social media ran by Adryan Does Art and the Designer.

Compensation:

The Client agrees to pay the Designer 50% of the total project cost before any services are provided, and the remaining 50% is to be paid before any workable files are delivered. If the parameters of the Work change, or if it involves more time than estimated, Designer will inform Client and they can renegotiate the Work’s cost/time frame. Designer is responsible for the payment of all federal, state, and/or local taxes with respect to the services he performs for the client as an independent contractor. The Client will not treat Designer as an employee for any purpose.

Refunds:

Designer is not obligated or required to carry out any form of refund towards Client for any reason, under any circumstances whatsoever. If Client is unsatisfied with any of the work provided by Designer during or after the allocated project time frame, negotiations for revisions and/or continued work can be agreed upon by both Designer and Client for the Work. 

Client Approval:

Upon acceptance of the Work, Client accepts responsibility for any further processes in which this work is used (e.g. film outpost, printing, etc.). The Designer is not responsible for errors occurring in this Work or projects related to this work after acceptance of the Work by the Client. The Designer is also not obligated to change, provide add-ons, or correct any part of the Work after completion and approval by the Client, unless new agreed terms are both settled on by both the Designer and the Client. Upon approval and deliverance of the Work, the Designer is not obligated to pay for or provide funds for any future payments or charges (if applicable).

Revisions:

A revision is defined as follows: “A revision constitutes a change or variation to an initially presented—or in-progress—design concept, and is typically a change meant to be a slight modification or course correction to progress toward the final design.” Any revision requested by the Client after being sent a concept regarding the Work will count as one (1) revision. The number of revisions agreed upon by both the Designer and Client are to be used before the deadline agreed on beforehand. If not all revisions are used before the set deadline, the Designer is not obligated to provide any more Work to the Client. Unless a new deadline, a new number of revisions, and new price for the continuation of the Work is agreed on by both parties, no further actions are required for the Work.

Cancellation:

Both parties understand that Client or Designer may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory between both parties. Upon written or verbal cancellation, Client is responsible for payment for all expenses incurred and any work done towards the completion of the project based on the percentage of the project completed that is determined by Designer. Should Client cancel the project following its completion, Client is responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, Designer retains ownership of all copyrights and original work created.

Acceptance of Terms:

Upon signature or payment, the Client promises to fully pay for the services rendered by Designer for the Work as agreed upon. Client agrees they have read, understood, and are considered legally bonded to these terms.
